Notice to Colorado Customers.
We are part of Lynx Design Studio, LLC which includes Lynx Design Studio+ and Shop Madern, from this point forward referred to as “We”. We are committed to complying with the State of Colorado’s notice and reporting requirements for sales use tax in the state of Colorado due to no physical or economic nexus. To comply with current notice and reporting requirements, we must comply with the following:
Provide a written notice on all invoices, order forms, sales receipts or similar correspondences, whether in paper or electronic form, to each purchaser at the time of each sale that states:
Colorado sales tax was not collected on this sale and the purchase is not exempt from Colorado sales or use tax merely because it is made over the internet or by other remote means, and the State of Colorado requires purchasers to report all purchases taxable in Colorado for which no tax was collected by the retailer and pay tax on those purchases (1 Colo. Code Regs. § 201-1:39-21-112(3.5)(4)(c)).
Provide an annual report to the purchaser:
By January 31 of each year, retailers must send all Colorado customers an annual report summarizing the customer’s reportable purchases for the prior calendar year. The details of what retailers must include in an annual purchase summary are listed in 1 Colo. Code Regs. § 201-1:39-21-112(3.5)(5)(a)(ii). and include the following:
The name of the marketplace facilitator or remote seller
A statement that the facilitator or remote seller did not collect sales tax in connection with your transactions and the purchaser may be required to remit use tax to the Colorado Department of Revenue.
A list by date, type and purchase price of each product purchased or leased by the purchaser from this marketplace facilitator and delivered to a location within Colorado.
Provide an annual report to the Colorado Department of Revenue:
Non-collecting retailers that are required to provide at least one annual purchase summary to a Colorado purchaser must file an annual customer information report with the Colorado Department of Revenue containing summarized information for all Colorado customers. The details of what retailers must include in the annual customer information report are listed in 1 Colo. Code Regs. § 201-1:39-21-112(3.5)(6)(a).:
The purchaser’s name, billing address, delivery address and, if different, the purchaser’s last known mailing address.
The total dollar amount of purchases from this marketplace facilitator.
The name and address of the marketplace facilitator that made the sale.
